Intellectual Property Policy

Last updated:

A matching hoodie set is a small piece of a love story, and the story should belong to the people wearing it, not to a company whose logo happens to be popular this year. That idea shapes how Kind Stitch treats intellectual property. This policy explains what we own, how you may use it, why we only stitch original designs and your own words, what we do when an order asks for someone else’s mark, and how rights owners can report a concern. Copyright notices have their own step-by-step process on our DMCA page; everything else, including trademarks, character names and publicity rights, is covered here.

Intellectual property at a glance

  • Kind Stitch designs are original. We do not license or copy outside artwork, logos or characters.
  • Personalization is limited to your own names, initials, dates, family names, “Est.” years and short sleeve text.
  • We refuse orders that ask for brand names, team names, logos, protected slogans or character names, and we refund that order line in full.
  • You may share links to our pages; you may not copy our designs, photos or text to sell or publish elsewhere.
  • Rights owners can report a concern to [email protected] or by post to 5510 Rosewood Street, Roeland Park, KS 66205, US. We reply within 24 hours on business days.

1. What Kind Stitch owns

Unless a page says otherwise, the following belong to Kind Stitch and are protected by copyright, trademark and other intellectual property laws in the United States and in the other countries where we sell:

  • The Kind Stitch name, wordmark and any logo or icon we use for the store.
  • Our embroidery designs, including motif drawings, paired layouts that complete each other across two garments, and lettering arrangements for names, dates and family crests.
  • Product photographs, preview images and the graphics used by the live personalization preview.
  • Written content on the site, such as product descriptions, the size guide, help articles and policy pages.
  • The selection and arrangement of the site as a whole, including collection structure and page layout.

1.1 What we do not claim

We do not claim ownership of your names, dates or other personalization text. We do not claim ownership of common symbols such as hearts, moons, stars or waves as ideas; our rights are in our particular drawings and arrangements of them. The software that runs the site belongs to its own authors and is used under its licenses.

2. How you may use our content

Permitted and not permitted uses of Kind Stitch content
You mayYou may not
Share a link to any product or page by message, email or social postDownload our product photos and post them as your own listing on another store or marketplace
Post photos you took of the Kind Stitch pieces you own and wearTrace, redraw or digitize our embroidery designs to produce and sell apparel
Print a page for your personal reference, for example the size guide before measuringCopy our product descriptions or policy pages onto another website
Quote a short line with a link back to the original pageUse the Kind Stitch name or anything confusingly similar in a way that suggests we are connected with you
Ask us for permission for other usesScrape or bulk-download the site with automated tools beyond normal search engine indexing

Wearing, gifting and photographing what you bought is, of course, exactly what we hope you do. A family photo in matching Big Star / Little Star tees is yours to share wherever you like.

3. Original designs only

Every motif in our collections was created for Kind Stitch. We do not resell licensed merchandise, and we do not produce designs that imitate a well-known brand’s look, a sports team’s crest or a character’s appearance. This keeps our catalog honest and keeps customers from receiving something that could be seized, reported or removed from a marketplace later.

The way our products work also limits risk. Personalization fields accept names, initials, dates (including roman numerals), a family name with an “Est.” year, short sleeve text, a thread color (White, Black, Terracotta, Navy or Mustard) and a chest position. Each field has a maximum length shown on the product page. There is no field for uploading artwork or logos.

4. Personalization and third-party rights

4.1 Your responsibility

When you submit personalization, you confirm that you have the right to use that text and that it does not infringe anyone’s trademark, copyright or right of publicity. The names of the people you love, the date you met and the year your family began are always welcome. Our Terms of Service set this out as a condition of every order.

4.2 What we do not accept

  • Brand names, product names or company names belonging to someone else.
  • Names, nicknames or abbreviations of sports teams, leagues or clubs.
  • Names of characters from films, television, books, comics or games, and their catchphrases.
  • Slogans, taglines and lyrics owned by someone else.
  • The name or likeness of a public figure used to suggest an endorsement.

4.3 What happens when an order includes them

We read personalization before production. If an order line contains a third-party mark or protected name, we email you before anything is stitched. You can replace the text with your own wording, or we cancel that order line and refund it in full. If the text is changed within 24 hours of ordering, the usual change window applies; if we find the problem later, we still contact you first and never produce the item as entered. We may refuse any order that, in our reasonable judgment, would infringe someone else’s rights.

4.4 A few examples

Personalization examples
Requested textOur answer
“Maya” and “Jordan” on a Moon and Star hoodie pairAccepted. Your own names.
“The Parkers, Est. 2016” on a family crewneck setAccepted. Your family name and year.
XII.VI.MMXIX on a sleeveAccepted. A date in roman numerals.
A sports team nickname on both hoodiesDeclined. Team names are trademarks owned by others.
A cartoon character’s name on a baby bodysuitDeclined. Character names belong to their owners.
A line from a popular songDeclined. Lyrics are protected by copyright.

4.5 Wedding parties, reunions and group orders

Matching sets are popular for bachelorette weekends, family reunions and holiday photos, and group orders follow the same rules as any other order. “The Okafor Reunion, Est. 1987” or the couple’s first names and wedding date are perfect. The name of a venue, a resort brand, a cruise line or a sports club is not, because those names belong to their owners. If you are not sure whether a word is safe, email us before you order and we will tell you honestly. It is much easier to adjust wording before checkout than to stop a set of eight hoodies after it.

4.6 Your own business name

If you own a small business and want its name on a family piece, you may include it only if you own that name or have permission from its owner. We may ask you to confirm this by email before production.

5. Other names on the site

If a name or mark that belongs to someone else ever appears on our site, for example the name of the software the site runs on, it belongs to its owner. Its appearance does not mean that owner sponsors, endorses or is connected with Kind Stitch.

6. How to report an intellectual property concern

If you believe something on kindstitch.shop, or a product we sell, infringes your trademark, design right, right of publicity or another intellectual property right, please tell us. Email [email protected] with the subject “IP concern”, or write to Kind Stitch, 5510 Rosewood Street, Roeland Park, KS 66205, US. Please include:

  1. Your name, email address and postal address, and your relationship to the rights owner.
  2. The right you are relying on, for example a trademark registration number and the country of registration, or a description of the design or the person whose name or likeness is used.
  3. The URL of each product or page concerned, and what on that page you are concerned about.
  4. A short explanation of why you believe it infringes your rights.
  5. A statement that the information in your report is accurate and that you are the rights owner or authorized to act for them.

For copyright, such as a claim that we copied an illustration or a photograph, use the process on our DMCA page, which asks for the specific elements copyright law requires.

7. What happens after you report

How we handle intellectual property reports
StageWhat to expect
AcknowledgmentA reply within 24 hours on business days confirming we have your report
QuestionsIf something is missing, we ask before deciding
DecisionWe review the material and, where the concern is valid, remove or change the product, image or text
Production stopAny affected design is withdrawn and no new orders for it are produced
Follow-upWe email you with what we changed or, if we disagree, our reasons

We would much rather fix a problem than argue about it. If you are a small creator who feels one of our designs is too close to your work, write to us plainly; you do not need a lawyer to start the conversation.

8. Repeated misuse

Customers who repeatedly try to order third-party marks, characters or protected text after we have explained this policy may have future orders refused and their accounts closed. Anyone who copies our designs or photos to sell elsewhere may receive a takedown request from us to the platform where the copies appear.

9. If you find copies of our designs

If you see a Kind Stitch design, photo or description being sold or published somewhere else, we appreciate a heads-up. Send the link to [email protected]. Please do not order from a copy expecting our sizing, embroidery or return terms; only orders placed at kindstitch.shop are covered by our 60-day return window and our refund timing.

When you report a copy, a screenshot of the listing and the date you saw it help us a great deal, because copied listings are often edited or taken down and put back up under a new name. We may not be able to share every step we take, but we will tell you when the matter is closed.

10. Ideas and feedback

Customers sometimes suggest a new motif, a new pairing or a new product. We love hearing them. If you send us an idea, we may use it freely without payment or credit, but we will never publish your name or personal details with it without your permission.

11. Permission requests and contact

To ask for permission to use our content, for example a photo for an article about couple gifts, or for any question about this policy, email [email protected]. We are an email-only store and reply within 24 hours on business days. Related pages: Terms of Service, Privacy Policy and Contact Us.
