Every Kind Stitch design starts as our own idea: a moon and a star that only make sense together, a family name with the year it all began, two sets of initials sitting side by side. We ask the same respect for creative work from everyone else, and we offer it in return. This page explains how a copyright owner can tell us about material on https://kindstitch.shop that they believe infringes their work, how we respond, and what someone can do if they believe material was removed by mistake. For trademarks, character names and other rights that are not copyright, see our Intellectual Property Policy.

Copyright notices at a glance

  • Send notices by email to [email protected] with the subject “Copyright notice”, or by post to Kind Stitch, 5510 Rosewood Street, Roeland Park, KS 66205, US.
  • A complete notice has six elements, listed in section 3. Missing elements slow everything down.
  • We confirm receipt of emailed notices within 24 hours on business days.
  • If a notice is valid, we take the material down and tell you when it is done.
  • People whose material was removed can send a counter-notice, described in section 6.
  • We refuse orders that ask us to embroider third-party marks, logos or characters.

1. What this page covers

Kind Stitch is a single store selling its own embroidered matching apparel. There are no outside sellers listing products here. Copyright questions about our site can therefore arise in a few specific places, and this page applies to all of them:

  • Embroidery designs and artwork shown on product pages, collection pages and the live personalization preview.
  • Product photographs, preview graphics and other images on the site.
  • Written content, such as product descriptions, guides and policy pages.
  • Personalization text a customer submits for an order, if it reproduces someone else’s protected work, such as song lyrics, a poem or a slogan.

The process follows the notice-and-takedown framework of the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). We apply the same process to copyright owners in Canada, Australia, New Zealand and elsewhere who contact us.

2. How our designs are created

Our designs are original to Kind Stitch: simple motifs, lettering layouts and pairings created for matching couple and family apparel. We do not build designs from other people’s artwork, and we do not accept personalization that copies protected text or images. Because personalization is limited to names, initials, dates, roman numerals, family names with an “Est.” year and short sleeve text, the risk of customer text reproducing a copyrighted work is small, but not zero. That is why we read personalization before production and contact the customer when something looks wrong.

3. How to send a copyright notice

A notice is a written message from the copyright owner, or someone authorized to act for them, that identifies the work and the material on our site. To be complete, it must contain all of the following:

  1. Your physical or electronic signature. A typed full name at the end of an email counts as an electronic signature.
  2. A description of the copyrighted work you believe has been infringed. If several works are involved, a representative list is enough.
  3. The exact location of the material on our site, ideally the full URL of each product or page, and a description of the specific image, design or text.
  4. Your contact information: full name, postal address, telephone number and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

3.1 Where to send it

Ways to deliver a copyright notice
MethodAddressGood to know
Email (fastest)[email protected]Use the subject “Copyright notice”. Attachments such as screenshots or registration documents are welcome.
PostKind Stitch, 5510 Rosewood Street, Roeland Park, KS 66205, USMark the envelope “Copyright notice”. Post takes longer to reach us than email; please include an email address for our reply.

We do not have a phone line or chat, so we cannot accept notices by phone.

3.2 Helpful extras

These are not required, but they help us move quickly: a link to where your original work is published, the date it was first published, a copyright registration number if you have one, and side-by-side images that show the similarity.

4. What happens after we receive a notice

Our steps after a copyright notice
StepWhat we do
1. AcknowledgeWe confirm we received your emailed notice within 24 hours on business days.
2. Check completenessIf an element from section 3 is missing, we tell you what is needed. We cannot act on a notice we cannot verify.
3. ReviewWe compare the material with the work described in your notice.
4. Remove or disableIf the notice is valid, we take down the image, design, text or product listing, and stop producing any affected item.
5. ConfirmWe email you to say what was removed.
6. Inform the other partyIf the material came from a customer’s personalization, we tell that customer, so they can respond under section 6.

We handle notices in the order they arrive and as quickly as a careful review allows. A notice about a product page usually affects nothing else; a notice about a design may affect several products that use it, and we remove all of them.

4.1 What we look at during review

We look at whether the work described in the notice is the kind of thing copyright protects, whether our material actually reproduces the protected expression rather than a general idea, and whether the sender has shown they own the work or act for the owner. A crescent moon, a star, a heart or a simple monogram are common shapes that no one owns as ideas; a specific drawing of them can be protected. Where the answer is not clear, we may ask you a follow-up question before deciding.

4.2 Things that are usually not a copyright matter

Short phrases, ordinary first names, initials, dates and roman numerals such as XII.VI.MMXIX are generally not protected by copyright on their own. Concerns about a brand name, a team name or a character name are trademark or publicity questions, and they belong under our Intellectual Property Policy rather than this page. Sending them through the right channel gets you an answer sooner.

5. Orders that are already in progress

Each Kind Stitch piece is embroidered after the order is placed, and processing takes 1–3 business days. If a valid notice concerns personalization on an order that has not yet been produced, we stop that order line, tell the customer and offer a change of text or a full refund. If the item has already shipped, we tell you so in our reply, and we will not produce that text again.

6. Counter-notice: if you believe material was removed by mistake

If material you provided was removed because of a copyright notice, and you believe it was removed by mistake or because it was misidentified, you can send us a counter-notice. It must include:

  1. Your physical or electronic signature.
  2. A description of the material that was removed and where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, postal address, telephone number and email address.
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, any judicial district in which Kind Stitch may be found, and that you will accept service of process from the person who sent the original notice or their agent.

Send it to [email protected] with the subject “Copyright counter-notice”, or by post to the address in section 3.1. We forward a complete counter-notice to the person who sent the original notice. If they do not tell us within 10 business days that they have filed a court action, we may restore the material within 10 to 14 business days after receiving the counter-notice.

7. Repeat infringers

We keep a record of valid notices. Customers who repeatedly submit personalization that infringes copyright will have their orders refused and their customer accounts closed. The same applies to anyone who repeatedly uses our site to try to copy and reproduce protected work. This policy protects copyright owners and also protects the many customers who simply want two names and a date stitched kindly.

8. Orders we refuse from the start

Most problems are prevented before a single stitch. We do not accept personalization that uses brand names, team names, logos, slogans owned by others or names of fictional characters, and we will not reproduce lyrics, poems or artwork that the customer does not own. When an order asks for something like that, we contact the customer before production and offer to change the text or refund the order line in full. The Terms of Service explain the customer’s responsibility for the text they submit.

9. False or misleading notices

Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or a counter-notice may be liable for damages, including costs and attorneys’ fees. Please make sure you own the work, or are authorized to act for the owner, and that the use is not permitted by law, such as fair use, before you send a notice. If you are unsure, consider getting legal advice first.

10. Privacy of the information you send

We use the contact details in a notice or counter-notice only to handle that matter. As the law requires, we may share a counter-notice, including the sender’s contact details, with the person who sent the original notice, and we may tell a customer that their material was removed because of a notice. Our Privacy Policy describes how long we keep correspondence.

11. Questions that are not copyright notices

This process is for copyright owners. If you are a customer with a question about an order, a typo in a name, a return or a delivery, please use our Submit a Ticket page or Contact Us so your message goes straight to the right place. If your concern is about a trademark, a design right, or the use of a name or likeness, our Intellectual Property Policy explains how to report it.
